3FOUR1: MEMBER TERMS AND CONDITIONS
3FOUR1 provides a way for adults to meet each other online and at events. This is a legal agreement ("Agreement") between you and 3FOUR1. Please read the Agreement carefully before registering for 3FOUR1. By registering for 3FOUR1, you become a member of 3FOUR1 and you agree to be bound by the terms and conditions of this Agreement (the "Terms") for as long as you continue to be a Member. If you do not agree to the Terms, please do not register for 3FOUR1. The Terms are subject to change by 3FOUR1 at any time, effective upon notice to you.

3FOUR1 is not a singles or networking matchmaking service nor are any of its services intended to result in matchmaking. Our goal is to help people meet one another in a safe and comfortable setting. 3FOUR1 does not verify personal information of its participants, such as marital status or any other aspects of an individual's background. It is your responsibility to verify information about an individual you meet by or through a 3FOUR1 event or venue.
3FOUR1 does not monitor participants registering for its programs. By registering for 3FOUR1 event, you agree that neither 3FOUR1 nor any of its associates or agents are liable for any damages, direct or indirect, that may in any way develop out of your association with 3FOUR1 or its programs. This includes, but is not limited to, any damages arising out of meeting or communicating with other participants in programs sponsored by or in any way affiliated with 3FOUR1.
MINORS MAY NOT BECOME MEMBERS By becoming a Member, you represent and warrant that you are at least 18 years old.
Either you or 3FOUR1 may terminate your membership at any time, for any reason, without explanation, effective upon sending written notice to the other party. 3FOUR1 reserves the right to immediately suspend or terminate your access to 3FOUR1.com or to any off-line 3FOUR1 event, without notice, upon any breach of this Agreement by you which is brought to 3FOUR1's attention. Your membership in 3FOUR1 service is for your sole, personal use. You may not authorize others to use your membership and you may not assign or otherwise transfer your account to any other person or entity. You are responsible for logging out if your computer is accessible to others. This prevents unauthorized access.
ONLINE CONDUCT
As a Member, you agree that:
1. You are solely responsible for the content or information you publish or display (hereinafter, "post") on 3FOUR1, or transmit to other 3FOUR1 Members.
2. You will not post on 3FOUR1, or transmit to other 3FOUR1 Members or Employees, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).
3. You will use 3FOUR1 in a manner consistent with any and all applicable laws and regulations.
4. You will not include in your profile any telephone numbers, street addresses, last names, URL's or E-mail addresses other than where asked for it in the Confidential Personal Information section.
5. You will not include in your profile any offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, and you will not post any photos containing nudity or personal information. 3FOUR1 reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions.
6. You will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through 3FOUR1. You will not transmit any chain letters or junk E-mail to other 3FOUR1 members. For protection of members against such conduct, 3FOUR1 has imposed a 30 message-per-day limit on subscribers.
7. You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
8. You are solely responsible for your interactions with other 3FOUR1 Members. 3FOUR1 reserves the right, but has no obligation, to monitor and/or mediate disputes between you and other Members.
9. By participating in any 3FOUR1 related event, you are giving permission for us to forward your email address to your mutual "matches" (any participants whom you choose and who also choose you).
10. We will not forward your email address to any other people in attendance at the event, without your prior permission.
11. Your participation in 3FOUR1 is at your own risk and you agree to waive any and all liability against 3FOUR1, the venue that the event is held at, any sponsors associated with the event or the Company, and/or all staff members associated with 3FOUR1.
12. 3FOUR1 does not screen participants and you agree to release 3FOUR1 from any liability and assume the risk and full responsibility regarding any person you meet at a 3FOUR1 event. To ensure your safety, we strongly encourage you to take the same precautions you would take in meeting any new person.
13. 3FOUR1 has the right to remove members from an event if this person acts in a way that 3FOUR1 deems defamatory, obscene, inflammatory, indecent or threatening in any way.
14. 3FOUR1 does not guarantee the results of any 3FOUR1 event, and does not guarantee that all participants will receive a match. All participants in 3FOUR1 events understand and acknowledge that 3FOUR1 provides an exciting and fun way of meeting new people. 3FOUR1 does not guarantee that any participant will successfully receive a match at our events. 3FOUR1 does not guarantee the success of any match between participants.
15. 3FOUR1 is not responsible for your matches contacting you. We are responsible only for exchanging contact information between you and your matches.
16. When buying a gift certificate for someone 3FOUR1 will send the gift certificate to the recipient on the day you noted, to the e-mail address you noted. 3FOUR1 will also send you a confirmation on that day. Please confirm with the recipient as 3FOUR1 is not responsible for the receiver not checking e-mail and confirming in time or the receiver not receiving the gift certificate due to the e-mail address that was provided being incorrect, or due to technical problems.
INDEMNITY BY MEMBER:
You will defend, indemnify, and hold harmless 3FOUR1, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of 3FOUR1 service, including any breach by you of the terms of this Agreement.
ONLINE CONTENT:
Opinions, advice, statements, offers, other information or content made available through 3FOUR1, but not directly by 3FOUR1, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. 3FOUR1 does not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than 3FOUR1. Under no circumstances will 3FOUR1 be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on 3FOUR1 or transmitted to 3FOUR1 members.
1. 3FOUR1 has the right to refuse a profile if it contains language or photos that 3FOUR1 deems defamatory, obscene, inflammatory, indecent, or threatening in any way.
2. 3FOUR1 has the right to edit a profile for use of improper spelling or grammar.
Cancellation Policy
If you need to cancel your attendance at an event with 3FOUR1, please send us an e-mail at 3FOUR1@gmail.com and title your e-mail "Cancellation." In the body of the e-mail, give us your first and last name and specify what event you are canceling. To receive a refund (minus an administration cost); please cancel 5 business days prior before the event.
We are unfortunately not able to give you a refund if: - You do not cancel five business days prior to the event. - You are so late that the event itself has already started.
PHOTOGRAPHY RELEASE NOTICE
Attention: Photographic images will be taken at 3FOUR1 events.
All photographic images contained on 3FOUR1 Website are sole property of: 3FOUR1.com
All photographic images throughout the Website are Copyright © 2009 3FOUR1 and as such it is illegal for any person to attempt reproducing them, or use them publicly without prior written permission by 3FOUR1. This includes, but is not limited to traditional printing and copying as well as electronic media. If you wish to use any of the images from your event as part of editorial or promotional content, please contact us via email.

Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. By posting information or content to any public area of 3FOUR1.com, you automatically grant, and you represent and warrant that you have the right to grant to 3FOUR1 and other 3FOUR1 Members an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing.

As a result 3FOUR1 will not be liable for any damages, direct, indirect, incidental and/or consequential, arising out of the use of this service, including, without limitation, to damages arising out of communicating and/or meeting with other members of this service, or introduced to you via this service. Such damages include, without limitation, physical damages, bodily injury and or emotional distress and discomfort. 3FOUR1 asks all prospective participants if they are single. But we do not verify this information. Therefore, 3FOUR1 is not liable for the integrity of statements made by members as to their identity, marital status and general background. It is incumbent and advised upon the user to verify any and all information relating to but not limited to this subject. It is advised to check references of any member.

Billing information
When signing up for an event using a credit card, you will be asked to provide additional financial information such as your credit card number, expiration date and billing address. We use encryption technology to protect your credit card information while in transit, via the Internet, to our servers. 3FOUR1 uses a 3rd party certified Merchant Bank for card processing.
Contact information
Your name, address, and telephone number are confidential. We will maintain this information in our secure database. We may use it to facilitate your user experience with our web site, as well as, when necessary, to contact you. Your e-mail address will also be stored in our secure database, and we may use this address to contact you with announcements and information regarding events. We may also provide your contact information to individuals with whom there is a mutual match, and to any individuals you have sent a second chance e-mail. In addition, some events are co-sponsored and promoted by an organization other than 3FOUR1 Events. For co-sponsored events, we reserve the right to share customer information from those events with the co-sponsoring organization. However, we will not sell or provide your contact information to any other organization who may be interested in making unsolicited contacts.
